ToS applies to all services (Vtuber, general commissions, etc)

VIOLATING THESE TERMS WILL TERMINATE
THE TRANSACTION BETWEEN CLIENT AND ARTIST.
THE ARTIST HAS THE RIGHT TO REFUSE A COMMISSION
OR CLIENT, PLEASE FULLY READ THESE TERMS.-Violating ToS will also put you on a blacklist-

GENERAL TERMS
.
| Posting –Client can request for their piece to be posted publicly, kept private or posted as "Private comm".| Process – Time of completion differs from comm to comm. Time is also effected by circumstances of the artist [Shep]- (order of comm, personal artwork, health, work, school/courses or family issues) which the Client will be notified of if issue arises.| Deadlines –Deadlines MIGHT be negotiable ahead of time (and in special cases might possibly increase comm price). Otherwise, there is no absolute deadline and or date that the client will acquire their piece. An ETA will be given, accordingly.| Payment – Full payment is expected before service as payment also secures a slot. Payment is suggested ASAP, slots will not be held. Partial payment/payment plans are only offered to larger projects and or pieces that reach over the 3 digit mark. (Example: 1.5k and up). Splitting payments and the price of said payments is up to the artist [Shep] to decide. Finished commissions will not be given to clients with payment plans until payments are completed. Payment/payment plan will be discussed. Once payment is fulfilled, there will be no option for refunds. If payments are stopped with no sign of fulfillment, I will keep all previous payments, there are NO refunds.ºInvoice will be via PAYPAL only, USD.º

Conditions
.WORKS DEPICTING THE FOLLOWING WILL BE REJECTED| Glorification of self-h•rm and su•cide of one's self, another person or character.
(However, concepts or pieces depicting those matters in an non-encouraging manner can be negotiated- (guro/Violent art, horror art, darker themes.)| Glorification of violence, terrorism, hate speech and violent extremism towards any specific person, group or brand especially communities of minorities| Sexualized depiction of an underage (under 18 years of age) person or character (loli, shota). This also includes adult real life people or characters who are modelled after children or catering towards the sexualization of minors| Heavy fetish works such as scat, vomit play, beastiality, etc-| Overly specific requests.(more about that in comm form)The artist -Shep- will update this list accordingly when offered comms with subject matter the artist is not comfortable with or confident in.

COPYRIGHT & USAGE POLICY
.The artist -Shep- holds the rights to the produced drawing, not the commissioner. Therefore the following is within the artist’s rights;| Promote their self with the art piece on any platform (Unless piece is PRIVATE)| Present the artwork as sample or portfolio piece to other individuals or groups
| Publish it physically for non-commercial purposes only.The artist is NOT allowed to turn the artwork or design into profitable goods or merchandise that will give gain personally or to any other individual or group who is NOT the client.

.The client is allowed to;| Use the artwork as a design for a physical good; such as paper-based works, merchandise, apparel or tattoos for only themselves
But cannot use it as goods to sell commercially.

.BREAKING THE COPYRIGHT'S TERMS IN ANY FORM WILL TAKE AWAY ANY RIGHT THE CLIENT HAD OVER THE WORK.The following is considered copyright infringement| Reproducing the artwork commercially (making money out of it, in any way, without the knowledge or consent of the artist)| Taking credit for the creation or crafting of the artwork itself| Removing or altering any watermarks/signatures without the consent or knowledge of the artistºYou may purchase commercial rights from the artist (minimum is 2-3x of the original rate but price will vary, contact the artist for more info)º

Important info to consider before commissioning.Heavy, intricately detailed comms, where every minor detail is extremely important and you're basically writing me a full story- it is not really my thing. Please keep your commission details reasonable.Less obviously, this leads to another question: Granting me artistic freedom.
Yay or Nay?Basically, I love artistic freedom (what artist doesnt!) as a rule. I really prefer the orders where the only description is to depict character X doing something.To put it simply, don't be overly specific. This is not meant to discourage you, I'm guiding you to a better outcome when working with me, specifically. Because looking back at it, the commissions with more freedom granted to me were simply better. I am sorry if my transparency on the subject offends or upsets you.Consider giving me a brief description of a scene, act, pose featuring your character(s).Here are some examples-"Good" description example: "Please make me a drawing of my OC, I want them acting cute while texting their partner, maybe have them sitting on a park bench, or on a bed. overall mood is cute, shy embarrassed and happy!""Plz don't" description example: "The drawing is going to be from an above fisheye perspective, my OC is texting, the phone they use is an iphonewhatever, its pink, and has a lot of charms, here's a link to the charms. They needs to be sitting at a park, its cloudy and the sky is casting purples and blues and there's birds. I want the phone to have very specific text conversation. their eyes are half shut and they're making a scrunched up face, one arm at their side, the other holding the phone texting. I want them to be sitting with their legs crossed and hair hanging over their face, they're leaning ever so slightly to the left- etc, etc, etc..."WHEW ＼(;´□｀)/PLEASE, remember I am not discouraging your creativity. But all in all, it is important to nail down key details and essentials, nothing else. Artistic freedom, man, don't be afraid of it! Being super-specific isn't always helpful.

VTUBER MODEL ART
Bust: $2700+

Design 4 u: $1300+ (added ontop of model price)
!General terms and notes!| View ToS to know what you can and cant do with the rig/art.| you can use the rig for personal use, streams, etc- but you must buy the commercial rights for commercial use.| Rigging/animation is not included. I am providing the art.| Please check my work before ordering as I will not heavily change my style.| Please have existing references for your model (like if it's an oc).| I will NOT create from description, sorry.| I can and will create a model/character from a moodboard if you want me to have creative freedom. Creating a character has additional fee.| More complex character designs may increase fee.| There are NO refunds offered.| Price listed is BASE price. It will increase after details of model commissions are explored.| Model will take up to a month give or take a week or two. If you are in a queue, depending on your spot, the wait is longer.
What you'll get| .psd layered model for rigging. (Note that I am still learning to 'cut' models. Vtuber Payment process-| Vtuber models are pricey (luxury INVESTMENT), Payment plans are possible.| Example: Model in total is $4300. Half payment is due upfront before work is started, $2150. Once payment is fulfilled completely, I will send over the model files.| If second payment is not made, I will keep the model, first deposit (no refunds) and I will alter the model for reselling/auction.| Prices listed are for personal use, not commercial use. Commercial rates are 2-3x base price; this can be discussed via email order. Commercial rights can always be purchased at a later date.)

| The artist retains the right to post the commission in my portfolio/social media.| Maximum of 2 changes allowed. Additional changes will have extra charge. (small changes ok but up to the artists discretion).| NO changes after the model has been completed.| Please provide the artist with the link to your twitch or youtube channel where you intend to use the model. If you haven't started a channel yet, please provide the artist your social media link so they can include the link when they post on my website.| You must credit the artist - objSHEP / SHEP - if you were to post the commission online/debut. The proper way to credit will be provided to you once you purchase the commission.| By purchasing you are automatically accepting my terms of service and being obligated to follow them.
